WHAT’S REQUIRED OF YOU

In addition to those matters set out above, the following terms and conditions apply to membership.

The YouTube For Ads Profit Program Basics:

1. We are committed to providing all Program participants with a positive program experience. This requires that all members meet the undertakings outlined in this agreement. If you fail to meet these expectations the Provider has the right to end this agreement and terminate your access to the YouTube For Ads Profit Program at their sole discretion.

2. Once your membership is confirmed you and your partner will be issued with an YouTube For Ads Profit Program Membership Website username and password, and a members area username and password. These are not to be shared with others. Your membership gives you (and your partner) access to the relevant members areas.

3. By joining the YouTube For Ads Profit Program you get access to the program and all inclusions for 6 calendar months. Your access to the YouTube For Ads Profit Program and all included additional services or workshops will come to an end at the end of 6 calendar months.

4. Individual components of the program are not severable, redeemable, transferable, or interchangeable if you are unable to attend or use them during the term of your membership. At the end of the 6 months program, any unused components of the program expire and are not redeemable for cash or otherwise. Your membership is not transferable. It cannot be sold or given to another person.

5. As some components of the YouTube For Ads Profit Program are reliant on external suppliers outside our control, the Program Providers reserve the right to change or substitute the offer, or components of the program at any stage with alternatives that we feel will be of equal or greater value to you.

6. As a member of the program we expect you to be respectful in your communication with us and our team, and other members. That includes communication via email, phone, Skype or face to face.

 
7. The Program Providers do not guarantee the services provided by third party suppliers referred to you by us and we are not responsible for any services contracted or provided by third party suppliers.

8. The Program Providers are not qualified to provide legal, tax, accounting, or financial advice, and the information provided to you by the Program Providers is not intended as such. You should refer all legal, tax, accounting, or financially related enquiries to appropriately qualified professionals.

9. We respect your confidential and proprietary information ideas, plans, and trade secrets (collectively, “confidential information”) and must insist that you respect the same rights of fellow YouTube For Ads Profit Program participants and of the Program Providers.

10. The Provider will begin work on the support and done-for-you components, only after you have completed and returned the requested information and attended your first strategy call. Only paid up members of the Program are eligible.

What is the payment and refund policy?

1. If you are not accepted as a member of the YouTube For Ads Profit Program your application fee will be refunded in full. 

2. If you notify us that you do not want to proceed with your application before we have accepted you as a member of the YouTube For Ads Profit Program, we will close your application and your application fee will be refunded in full.

3. Once we have accepted your application as a member of the YouTube For Ads Profit Program, the application fee is not refundable.

4. Once you have been accepted as a member of the YouTube For Ads Profit Program you are obliged to pay the balance of your membership.

 
5. We may consent to allow you to pay for the program in 13 x monthly installments (after payment of the application fee), or in one up-front payment, for which you will receive a discount.

6. There is no money back guarantee on the YouTube For Ads Profit Program. Every participant’s results will vary depending upon their personal participation.

7. The Provider will at all times comply with all applicable Consumer Laws in respect to refund requirements.

8. The Provisions of the applicable consumer laws that require refunds do not include: changes of mind, changes of circumstances nor changes of situations.

9. If your circumstances change for any reason and in any way and you are unable to complete the process, there will be no refunds, partial or otherwise. We have expended considerable time and money to provide for you in this group and those costs are spread across the limited number of persons accepted. Therefore your choice to join the group forms part of the financial success of the group and cannot be cancelled.

10. If you wish to terminate your membership of the YouTube For Ads Profit Program during the term of membership, you are still obliged to pay in full for the YouTube For Ads Profit Program.

11. If any account remains overdue after 30 days then an amount of the greater of $20.00 or 10% of the amount overdue (up to a maximum of $200.00) shall be levied for administration fees which sum will become immediately due and payable.

12. Interest may be charged on any overdue payment, accruing daily from the date when payment becomes due, until the date of payment, at a rate of 10% per year.

13. In the event that any payment is dishonoured for any reason you may be liable for any dishonour fees incurred by the Program Providers, as well as any costs and disbursements incurred by the Program Providers in pursuing the debt (including legal costs on a solicitor and own client basis and the Program Provider’s collection agency costs).

14. If at any time you are in breach of any obligation (including those relating to payment) the Program Providers may suspend or terminate the provision of the YouTube For Ads Profit Program and membership access to you and any of our other obligations under this agreement. We will not be liable to you for any loss or damage you may suffer because we have exercised our rights under this clause. Any suspension imposed as a result of your breach of obligation will not extend the term of your membership beyond the original membership term. If your payments become overdue by 5 days or more provision of all services will be suspended until your payments are brought up to date.

Payment and refund policy continue:

1. Without prejudice to the Program Providers’ other remedies at law, the Program Providers shall be entitled to cancel all or any part of your membership of the YouTube For Ads Profit Program and all amounts owing to the Program Providers will, whether or not due for payment under the installment arrangement, become immediately payable in the event that:

• any money payable to Program Providers becomes overdue, or in the opinion of the Program Providers you will be unable to meet your payments as they fall due; or
• you become insolvent, convene a meeting with your creditors or propose or enter into an arrangement with creditors, or make an assignment for the benefit of your creditors; or
• a receiver, manager, liquidator (provisional or otherwise) or similar person is appointed in respect of you or any your assets.

Your acknowledgement and undertakings:

By paying the initial invoice:

Responsibility

1. You agree to keep your YouTube For Ads Profit usernames and passwords secure and not to share access to the websites with anyone who is not a member.

2. You agree that the Program Providers and other members of the YouTube For Ads Profit Program are not responsible for any success or failure that you may have as a result of this agreement or your participation as a member of the YouTube For Ads Profit Program.

 
3. You agree not to hold the Program Providers, and other members of the YouTube For Ads Profit Program liable or accountable in any way for any failure of the service to live up to your expectations.

 
4. You acknowledge that the Program Providers are not qualified to provide legal, tax, accounting, or financial advice, and the information provided to you by the Program Providers is not intended as such. You agree to refer all legal, tax, accounting, or financially related enquiries to appropriately qualified professionals.

5. All information including material as referred to or provided to you by the Program Providers has been obtained by the Program Providers solely from their own experience as business owners and is referred to or provided as general information only, which:

• will require further research to identify its application to your specific requirements
• will, dependent on the further research to be undertaken, will require modification to appropriately apply to your specific requirements
• is referred to or provided by way of example only and is not intended to be nor is it acceptable as specific investment recommendations or advice for you.

Your acknowledgement and undertakings:

1. You understand that your individual success will be determined by your own desire, dedication, effort and motivation to work and follow the program.

2. You understand that failed business projects, mistakes and losses are a real possibility for you and your associated entities if you do decide to pursue and engage in specific or similar business activities and/or investments presented by the Program. Therefore you understand and agree that these business activities carry an inherent element of risk and you accept full responsibility for this risk and its consequences.

3. You understand and agree that (while given in good faith) all information and materials gained through the Program should not be relied upon in any way. Therefore you commit to undertake careful and competent due diligence from independent sources before taking any action or inaction as a consequence of information gained through the YouTube For Ads Profit Program.

4. You acknowledge that as with any business endeavor there is an inherent risk of loss of capital and there is no guarantee that you will earn any money as a result of your participation in the YouTube For Ads Profit Program. You agree that the information given by the Program Providers is one of the many learning tools that you may require before participating in your own business. 

Release:

1. You release forever the Program Providers from all and any responsibility or liability for any losses claims or demands that may directly or indirectly occur as a result of you using the information obtained through the YouTube For Ads Profit Program for any investment or other purposes, to the fullest extent permissible by law.

Privacy, confidentiality, intellectual property and copyright

1. We respect your privacy and must insist that you respect the privacy of fellow YouTube For Ads Profit members. You agree not to violate the privacy of any participant in the YouTube For Ads Profit Program.

2. You agree that any confidential information shared by YouTube For Ads Profit Program participants or the Program Providers or other presenters is confidential and proprietary, and belongs solely and exclusively to the person or entity that discloses it.

3. You agree not to disclose confidential information to any other person or use it in any manner other than in discussion with the Provider or other YouTube For Ads Profit Program participants during program sessions.

4. You acknowledge that any confidential information shared by you during the program is done so at your own risk, and you waive any right to seek recourse from the Program Providers for any loss or damage suffered as a result of sharing that information.

5. You agree not to infringe the copyright, patent, trade mark, trade secret or other intellectual property rights of the Provider or any YouTube For Ads Profit Program participant.

6. You represent that all graphics and text including logos, trademarks and photos given to the Provider for use on your website, Facebook page, advertisements or other marketing do not violate copyright law.

7. All images supplied by you will only be used after you give authorization, and are your sole responsibility regarding usage and copyright. Should any legal issues or claims arise from the content or copyright of any images supplied by you, they will be your sole responsibility.

8. You agree to hold the Provider harmless from any and all liability, claims or causes of action arising out of use of the content provided by you.

9. All materials created by the Program participant are your property. You grant to the Provider the right to use your work for demonstration of past work performed and/or advertising purposes only. You represent that all graphics and text including logos, trademarks and photos given to the Provider do not violate Australian, United States or other copyright law.

Restraint

You acknowledge that your membership of the YouTube For Ads Profit Program does not give you the right to represent (whether expressly or implied) or hold out to any person that you are a representative, agent, employee, partner or in any way connected with the Program Providers or other YouTube For Ads Profit Program members

Payment of fees

1. You agree that if you are accepted into the program, you are responsible for full payment of fees for the entire 6-month course of the program, regardless of whether you actually attend or complete the program. You agree that this is fair because there are only limited places in the YouTube For Ads Profit Program.

2. If paying by way of monthly installments, you agree to pay all monthly payments on a timely basis.

3. You agree to pay the full amount agreed and not to cancel this transaction with your bank or credit card company. If there is a problem you agree to promptly contact the Program Providers to resolve it.

4. You also acknowledge that you have represented to the Program Providers that payment of your YouTube For Ads Profit Program membership fees will not place a significant financial burden on you or your family.

Other terms and conditions

The Retreat is non-transferable, non-refundable and non-exchangeable. The trip applies to two people. If you wish to add additional travelers this must be discussed with the Provider. If they consent, you may be able to add additional members at a cost. Members are responsible for their own travel arrangements, booking flights and transfers to and from the Fast Track Retreat and associated costs. The retreat cannot be sold or given to another person. It is not redeemable for cash in part or in whole. If you decide not to attend the retreat there will be no refund of the balance. Only paid up members of the Program are eligible to attend. The YouTube Ads Fast Track Retreat must be taken as offered and cannot be varied. We will provide you with a deadline by which you must confirm attendance. If you do not confirm attendance by the given date, you will be responsible for any increase in cost, including increase in airfares. If you do not confirm attendance by the given date we cannot guarantee you a place at the retreat. If you confirm attendance and later cancel, we will charge an administrative fee of $750 per person.

In the event the YouTube Ads Fast Track Retreat is unavailable or canceled for any reason whatsoever, the Provider reserves the right to substitute an alternative of equal value. The alternative may not be on the same dates. This is at the sole discretion of the Provider. The Provider is not responsible for additional costs members may incur as a result of these changes, or an inability to travel due to a change in dates. Accommodation is provided for one person. Members are responsible for their own expenses, including insurance and personal expenses. Should your payments for the Program be in arrears you will not be eligible to attend the YouTube Ads Fast Track Retreat. 

Please note that results mentioned in The Titan Marketer YouTube Advertising Success Program are not typical. Where specific marketing figures are used and attributed to an individual or business, those persons or businesses have earned that amount and those figures are used as illustration and example only. There is no assurance you’ll do as well. If you rely upon figures, you must accept the risk of not doing as well.
